2. The petitioner has preferred this application for grant of regular bail in connection with Manpur P.S. Case No. 118 of 2024 dated 16.08.2024 registered for the offences punishable u/s 191(2), 191(3), 190, 140(1), 61(2), 103, 103(2), 126(2), 115(2), 74, 238, 324(4) of B.N.S.
3. As per the prosecution case, the petitioners along with others abducted the brother of the informant. After that they assaulted him with an iron rod, hockey stick and threw the dead body in Gordhoba River. It is also alleged that knife blow was given in both of the eyes. The brother of the informant was brutally murdered.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.35615 of 2025(2) dt.23-06-2025 2/2 this case. The petitioner is named in the FIR. There is no eye witness to the alleged occurrence. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused person has already been granted bail by the co-ordinate bench of this Court vide order dated 11.02.2025 passed in Cr. Misc. No. of 88514 of 2024. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 12.02.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, in connection with Manpur P.S. Case No. 118 of
7. This application is allowed.
