Petitioner is not named in the first information report nor the informant is an eye witness of the alleged occurrence. It would appear from perusal of the case diary that in course of investigation, I.O received a telephonic message from an unknown person, who claimed to have seen the actual killing of the deceased and disclosed the name of the petitioner as one of the participants of the alleged crime. It is surprising enough that the I.O did not take any pain to trace out the name of the person, who had given the aforesaid information.

No doubt, petitioner carries criminal antecedent of several cases but it appears that except the aforesaid material,

Patna High Court Cr.Misc. No.30358 of 2015 (3) dt.29-10-2015 2/2 there is nothing against the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S.Case No. 42 of 2014.
