The petitioners apprehend their arrest in connection with Ramgarh P.S. Case No.16 of 2019 registered under Sections 147, 148, 149, 452, 332, 333, 435, 436, 337, 338, 323, 224, 225, 307, 153(AA), 353, 342, 160, 379 and 120B of the Indian Penal Code besides Sections 3/4 of the Prevention of Damage to Public Property Act.

The accusation is that the mob of 101 persons, named in

Patna High Court CR. MISC. No.32928 of 2019(2) dt.20-05-2019 2/2 the F.I.R., including the petitioners along with others attacked on the police station and ransacked the same. At that time, they also bunrt the vehicles. The mob was agitated due to commission of rape and murder of a female and inaction of the police. Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act is attributed to them. Further submission is that the similarly situated co-accused Chhotelal Ram and Nandu Ram have already been granted the privilege of pre-arrest bail by a Bench of this Court vide order dated 04.04.2019 passed in Criminal Misc. No.21142 of 2019.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Kaimur at Bhabua, in connection with Ramgarh P.S. Case No.16 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
