The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 30(d) and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on information having received that the petitioner was involved in manufacture of liquor in the house of the co-accused, a raid was conducted. It is stated that one accused managed to escape who was identified by the choukidar as the petitioner herein. A total of 375 litres of liquor under preparation was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the seized liquor nor with the place of recovery. He has been falsely implicated in the case

Patna High Court CR. MISC. No.45270 of 2021(2) dt.29-01-2022 2/2 because of his antecedents. The petitioner is in custody since 8.4.2021 and charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not being arrested at the spot and having remained in custody for over 9 months, the Court directs the petitioner to be enlarged on bail in connection with Warsliganj P.S. Case no. 64 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Nawada.
