JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 304(B)/34, 201 of the Indian Penal Code. The allegation against the petitioner and other accused persons is of killing the daughter of the informant for non fulfillment of demand of dowry.

It is submitted on behalf of the petitioner that the petitioner is in custody since 25.01.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses alleged against the petitioner. Number of witnesses have been examined in course of investigation, whose statements are recorded in paras 7,8,9,10 and 11 of the case diary. They have

No.23510 of 2016 (4) dt.09-08-2016 2/2 stated that for some petty reason, there was hot exchange between the petitioner and the deceased and for the said reason the deceased locked room and hanged herself committing suicide. Ultimately her dead body was recovered after breaking the door of the room where she had hanged herself.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge- IVth, Sasaram, DistrictRohtas in connection with S.Tr. No. 119 of 2016 arising out of Nauhatta P.S.Case No. 39 of 2015.
