JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Syed Firoz Raza, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Ahiyapur P. S. Case No. 53 of 2020 dated 14.01.2020, instituted for offences under Sections 400, 401, 402, 414 and 34 of the Indian Penal Code and Section 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

It has been submitted on behalf of the petitioner that the recovery of 1 kg. Ganja has wrongly been foisted upon him. In fact the petitioner was picked from his house and was made accused in this case.

Considering the quantum of recovery and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge - cum - Special Judge, Muzaffarpur, in connection with Ahiyapur P. S. Case No. 53 of 2020. The petition stands allowed.
