JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. Neither petitioner was caught on the spot nor anything was recovered either from his conscious possession or from his house. No doubt, petitioner does have criminal antecedent, which is evident from perusal of Para 3 of the case diary but in the present case, except the statement of Suman Kumar Sah, there is nothing against the petitioner, who is languishing in jail custody since 27.11.2018. Considering the aforesaid facts and circumstances as

S. Case No. 174 of 2017.
