Patna High Court CWJC No.8354 of 2018(3) dt.26-07-2022 2/3 ORAL ORDER 26-07-2022 Though, the present writ petition has been filed for directing the respondents to issue the sale deed in question, however, the learned counsel for the Respondent State has filed a counter affidavit in which an order dated 23.10.2018 passed by the Assistant Inspector General of Registration, Patna Division, Patna in Case No. 182/ 2002-03 has been annexed, whereby and whereunder it has been held that the petitioner is liable to deposit deficit stamp fee to the extent of a sum of Rs. 12,768/- along with penalty of a sum of Rs. 1277/-. At this juncture, the learned counsel for the petitioner submits that the petitioner shall pay the aforesaid sum of Rs. 14,045/- within a period of two weeks from today, however, it be directed that no interest shall be charged since the petitioner has come to know about the said order dated 23.10.2018 today when a copy of the counter affidavit has been served upon the learned counsel for the petitioner and has also been filed before this Court today itself.

Accordingly, the present writ petition shall stand disposed of with liberty to the petitioner to pay a sum of Rs. 14045/- within a period of two weeks from today and in case the petitioner pays the said amount within two weeks, the Respondents shall handover the registered sale deed to the
