The petitioner is in custody since 27.04.2016 in connection with a case registered for the offences punishable under Sections 272/273/290 of the Indian Penal Code and Section 47-A of the Excise Act.
Considering the fact that it has now been held vide order dated 26.05.2016 passed in Cr.W.J.C. No. 533 of 2016, that possession simpliciter is not an offence under the Amended Excise Act, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S.
