JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Pakari Dayal P.S. Case No. 119/2015, disclosing offences under section 302 of the Indian Penal Code.
The petitioner is the father of the deceased, two years child.
Learned counsel for the petitioner has submitted that the trial has commenced and in course of trial none of the witnesses have supported the prosecution case including the informant himself. He has further submitted that even the mother of the child has not supported the allegation made in the F.I.R., who appears to have died in an accident.
Patna High Court Cr.Misc. No.23042 of 2016 (2) dt.26-05-2016 Considering the fact that the trial has commenced and many of the witnesses have been examined, I am not inclined to grant the petitioner regular bail at this stage. This application is, accordingly, rejected.
It is observed that the conclusion of S.Tr.No. 58/2016 be expedited and concluded within a period of three months from the date of receipt/ production of a copy of this order. If within the aforesaid period the trial is not concluded, the petitioner shall have the liberty to renew his prayer for regular bail. (Chakradhari Sharan Singh, J) Surendra/- U
