The petitioner seeks bail in Runnisaidpur P.S. Case No. 56 of 2021, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code. As per the FIR, this petitioner is alleged to have enticed away the minor daughter of informant for the purpose of marriage.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Informant is not eye-witness of the occurrence. In fact, there is love affair between the petitioner and the victim girl. The victim girl in her statement under Section 164 Cr.P.C has denied the factum of her

Patna High Court CR. MISC. No.45229 of 2021(3) dt.04-01-2022 2/2 kidnapping. The victim girl in her statement under Section 164 Cr.P.C has not made allegation of sexual assault against this petitioner. Petitioner is in custody since 20.01.2021 having clean antecedent.

Considering the statement of victim girl under Section 164 Cr.P.C and period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 56 of 2021.
