2. The petitioners are apprehending their arrest in connection with Ramgarhwa P.S. Case No. 10 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109(1), 303(2), 3(5) of the BNS.

Allegedly on the given date and time, while the informant was returning to his home, in the meanwhile, all the accused persons, including the petitioners, armed with lathi, iron rod and farsa surrounded him and brutally assaulted. It is specifically alleged that petitioner no. 1 assaulted over the head
Patna High Court CR. MISC. No.36290 of 2026(2) dt.02-06-2026 2/3 of the informant by means of farsa due to which he sustained serious injury, besides there is allegation of snatching of valuable. It is also alleged that earlier on 04.01.2026, the accused persons have assaulted the informant's neighbour Akash Kumar.
4.Learned Advocate for the petitioners referring to the FIR contended that so far the occurrence with respect to 04.01.2026 is concerned, no FIR has been instituted. With respect to the present occurrence which took place on 06.01.2026, the present FIR came to be instituted on 10.01.2026 without any explanation of delay. There is counter version of the present case being Ramgarhwa P.S. Case No. 13 of 2026 against the informant and others. In fact, on the alleged date of occurrence, both the parties have entered into a free fight which resulted into unfortunate injuries to the persons of both the sides. So far the injury which is allegedly sustained to the informant is concerned, the same has been found to be simple in nature as is evident from the impugned order. The petitioners bear fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of delay in lodging of the FIR, coupled with the factum of case and counter case as also the fair antecedent and simple nature of injury, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Motihari in connection with Ramgarhwa P.S. Case No. 10 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
