1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that co-accused Navin Kumar, Secretary State Women's Development Organization was selected to impart training of Computer Education in eight middle schools of

Patna High Court CR. MISC. No.36998 of 2026(2) dt.15-06-2026 2/3 Dumri Sub-Division and nine middle school of Sheohar SubDivision. Accordingly, an amount of Rs.6,80,000/- was paid to the said organization in two instalments but on enquiry, it was found that the work has not been rendered satisfactorily, thus it is alleged that government money was misappropriated.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that FIR is of the Year 2013 and the name of the petitioners transpired in the instant case in the Year 2020 and they were not even aware of their implication in the instant case as petitioner nos.1, 2 and 3 had retired in the Year 2013, 2014 and 2015 respectively. It is further submitted that Nandu Kishore Singh @ Nandkishor Singh had approached this Court seeking anticipatory bail by filing Cr. Misc. No.53800 of 2024 and the same came to be allowed by an order dated 28.08.2024 passed by a learned Coordinate Bench. It is further submitted that case of the petitioner if not akin is similar to the case of Nandu Kishore Singh.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the

Patna High Court CR. MISC. No.36998 of 2026(2) dt.15-06-2026 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Shyampur Bhataha P. S. Case No.54 of 2013, subject to the conditions laid down under Section 482(2) of the B.N.S.

7. The application stands allowed.
