ANJANA MISHRA ORAL ORDER 02-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 15.03.2016 in connection with a case registered for the offences punishable under Sections 401/414 of the Indian Penal Code.

Learned counsel for the petitioner submits that though in the First Information Report it is stated that the petitioner was caught at the place of occurrence but no incriminating article was recovered from his possession. It is submitted that actually the petitioner was present near the Peepal tree and the articles purported to have been recovered by the Police are not stolen articles. So far as this petitioner is concerned, there being no criminal antecedent as alleged and the petitioner was merely sitting under the Peepal tree from where he was arrested.

No.24365 of 2016 (2) dt.02-06-2016 P2/2 Considering the aforementioned facts and circumstances and that there was no recovery from the conscious possession of the petitioner, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Gaya in connection with Delha P.S. Case No. 56/2016.
