====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Satyam Shivam Sundaram, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned APP for the State.

The petitioner seeks bail in connection with Surygarha P. S. Case No. 37 of 2020 dated 26.02.2020, instituted for offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Though a huge quantity of liquor is said to have been recovered but the petitioner and nine (9) other persons are also stated to have been present at the place where recovery was made. There is no recovery

Patna High Court CR. MISC. No.33538 of 2020(2) dt.16-12-2020 2/2 from the personal possession of the petitioner. Some of the similarly situated accused persons have been granted bail by different Benches of this Court.

The petitioner is in custody since 27.02.2020 and in the earlier cases lodged against the petitioner, which is not of the similar nature, he has been granted bail.

Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. - 1st, Lakhisarai, in connection with Surygarha P. S. Case No. 37 of 2020.

The petition stands allowed.
