JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
Petitioners are said to be owner of D.J. sound system which had been played at the time of procession of Ramnawmi. The claim of the prosecution is that members of both community pelted stones on each others as well as police officials but it is surprising enough that members of only one community were made accused in this case. Moreover, no specific overt-act has been attributed against the petitioners, who are languishing in jail custody since long.

No.25221 of 2016 (3) dt.24-06-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 297 of 2016.
