Petitioner happens to be husband of the deceased and is languishing in jail custody since 14.11.2014. Originally, the case was registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code but in course of investigation, it came to light that deceased committed suicide due to petty family feud. Although, some witnesses stated that there was demand of motorcycle and for the aforesaid demand, the deceased was being tortured but it has specifically been pleaded by the witnesses that on the alleged date of occurrence an altercation had taken place between the deceased and her younger

Patna High Court Cr.Misc. No.13750 of 2015 (3) dt.29-06-2015 brother in law on the point of preparation of meal and on account of the aforesaid altercation, she committed suicide. Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara in connection with Ayer P.S. Case No. 70 of 2014.
