2. Heard the parties.
3. The present writ petition has been preferred for the following relief(s):
for Payment of due Compansation with interest for taking Possession and took in the alignment of Patna-Buxar four lane
Patna High Court CWJC No.4868 of 2017(2) dt.01-09-2025 2/3 project of the land Comprising an area of 39 decimal of Plot No, 238, Khata No. 338, Mauja-Parev, Survey Thana No.41, P.S:- Bihta, District:-Patna which is Petitioner's ancestral land.
4. Though the State as always remains lethargic in filing reply and nothing has been brought on record showing the recent development, this Court has to take help of the Interlocutory Application (I.A. No. 03 of 2024) preferred by the petitioner to come to a conclusion.
5. According to paragraph 9 of the said I.A. on 25.01.2024, through RTGS, the respondents have cleared Rs. 64,16,000/- as per the CALA Award.
6. Petitioner still is/are aggrieved and intend to agitate the matter before the appropriate authority/competent Court.
7. In that background, granting liberty to the petitioner to approach the authority, the Arbitrator-cum-Divisional Commissioner, Patna for the redressal of the grievance, the writ petition is disposed of.
8. If such petition is preferred in next four weeks, the concerned authority shall see to it that the matter was pending before this Court for long while dealing with the limitation petition. The matter has to be taken to its logical conclusion at an earliest preferably by 31.03.2026.
