The petitioner is languishing in custody since 27.12.2015 in connection with Hawai Adda P.S. Case No. 183 of 2015 for the offences instituted under Sections 392 and 411 of the I.P.C. The prosecution story, in brief, is that on the alleged date of occurrence, two persons on the point of pistol forcibly took away the Bolero vehicle of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.12.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. He is not named in the F.I.R. He has
Patna High Court Cr.Misc. No.24841 of 2016 (3) dt.08-08-2016 2/2 not been put on T.I. Parade to ascertain his involvement in the present case. The alleged Bolero vehicle is said to have been recovered from the Garage of the petitioner. The petitioner had no knowledge that the vehicle in question is a stolen one. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Patna, in connection with Hawai Adda P.S.
