The petitioner seeks bail in anticipation of his arrest in connection with Government Official Excise Complaint Case No. CIII 145/2020 dated 25.06.2020 instituted for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2018.

It appears that 26 litres of liquor was recovered from near a canal. The petitioner was seen fleeing away from the place of raid.

Learned counsel for the petitioner has submitted that he was working as a Welder in the Reliance Company in Jamnagar and he has falsely been made accused in this case.

No.32539 of 2020(2) dt.19-02-2021 2/2 Considering the fact that there is no recovery from the exclusive or constructive possession of the petitioner and that he has no criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Excise Act, Siwan in connection with Government Official Excise Complaint Case No. CIII, 145/2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
