Petitioner is accused in connection with S. Tr. No. 105 of 2016 arising out of Laheriasarai P.S. Case No. 323 of 2015 registered under Sections 302/34 of the I.P.C. The accusation is that on 12.07.2015 at about 3:00 pm., Alok Kumar, son of the informant, moved from the house along with Rohit Kumar. On the same day, at about 10:00 pm. informant received a telephone call through mobile of his son to the effect that his son Alok Kumar is lying dead near M.L. Academy. The informant went there and found the dead body of his son lying near the Railway Track in Mohalla-Shiv Sagar. Informant came to know that when his son proceeded from the

Patna High Court Cr.Misc. No.25017 of 2016 (4) dt.03-08-2016 2/2 house with petitioner, on the way, five persons also accompanied to them. He raised suspicion that under conspiracy, they have committed murder of his son.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that son of the informant moved with the petitioner at 3:00 pm. in the day and his dead body was found at about 10:00 pm. in the night near the Railway Track. In between that period, the petitioner was not seen with the deceased. It is further submitted that mere on suspicion, the informant has implicated the petitioner having hand in the murder of his son. Further, submission is that petitioner has no criminal antecedent and is in custody since 17.02.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Darbhanga in connection with Sessions Trial No. 105 of 2016 arising out of Laheriasarai P.S. Case No.323 of 2015.
