JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nawada Town P.S. Case No. 658 of 2018 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

Allegation as per FIR is that co-accused person was intercepted and one stolen motorcycle was recovered from other co-accused and they disclosed the name of the petitioner as a member of gang, on which police raided the house of the petitioner and two motorcycles were recovered from there. Submission of learned counsel for the petitioner is that nothing has been recovered from his house and he has falsely been implicated and further one motorcycle belongs to him and he is ready to produce the paper but he has no explanation with respect to other motorcycle.

In view of above facts and circumstances, let petitioner surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
