Petitioner is in custody in connection with Baliya P.S. Case No. 334 of 2018 for the offence under sections 307, 353, 34 of the Indian Penal Code and Section 25(1-AA1)/25)1A)(a)/26, 27, 34 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 24.11.2018.

He further submits that seizure list was not prepared in accordance with the mandatory section 100 of Cr.P.C.. Learned counsel submits that similarly circumstanced other co-accused have been granted bail by this court vide order dated 16.5.2019 in Cr. Misc. No. 32251 of 2019.

No.34477 of 2019(2) dt.27-05-2019 2/2 Considering the fact that petitioner has remained in custody for more than six months and similarly circumstanced other co-accused have been granted bail by this court, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Balliya P.S. Case No. 334 of 2018 subject to the condition that one of the bailors should be elected representative of the local body.
