The petitioner seeks bail in Marhaura P.S. Case No. 115 of 2020, registered for the offence punishable under Sections 302, 120(B), 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on the alleged date and time of occurrence while informant and his son were going to Marhowrah Gola Bazar by motorcycle and the moment when they reached near Pakha Railway Dhala this petitioner along with other accused persons intercepted them and on the order co-accused Shivji Thakur, co-accused Sanjay Kumar Singh fired upon his son who died on the spot.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. There is no

No specific allegation of any overt act has been alleged against this petitioner. Petitioner is in custody since 21.04.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhaura P.S. Case No. 115 of 2020.
