=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 14-06-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Naurangia P.S. Case No. 18 of 2016 dated 29.04.2016 instituted under Section 47 of the Excise Act.

The allegation against the petitioner is of possessing four bottles of country made liquor, containing 200 ml. each. Learned counsel for the petitioner submits that the petitioner works as a rickshaw puller in the city of Gorakhpur in the State of Uttar Pradesh and was coming home for the marriage of his cousin brother and had, thus, brought the country made liquor to celebrate without being aware of the fact that there was ban in the State of Bihar and, in fact, even possession of liquor has been made

Patna High Court Cr.Misc. No.25162 of 2016 dt.14-06-2016 2/2 illegal. Learned counsel submits that petitioner, having clean antecedent, is in custody since 30.04.2016.

Learned A.P.P. submits that the petitioner was in possession of country made liquor which is prohibited. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha in Naurangia P.S.Case No. 18 of 2016, subject to the condition that the petitioner shall cooperate in the trial and failure to do so shall lead to cancellation of his bail bonds.
