The petitioners seek bail in a case registered for the offences punishable under Section 302 and other sections of the Indian Penal Code.

The informant, son of the deceased, alleged that petitioners and Md. Aslam came and began to abuse. Some verbal altercation took place and other accused persons also came there. It is alleged that Md. Aslam assaulted Md. Taskeen, the father of the informant with dabia, a sharp cutting weapon on his head. Thereafter, petitioners are alleged to have assaulted the deceased with lathi. Petitioners are also alleged to have assaulted Minhaz and Noorjehan, the brother and mother of the informant. It is submitted that Md. Taskeen, the deceased got one incised wound on his head on account of which he died. The head

Patna High Court Cr.Misc. No.30214 of 2015 (2) dt.11-08-2015 2/2 injury is attributed to Md. Aslam. Md. Minhaz and Noorjehan got many injury but all the injuries are simple in nature. Petitioners are in jail since 21.11.2014.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Katihar in Sessions Trial No. 172 of 2015 arising out of Barsoi P.S. Case No. 185 of 2014.
