2. The petitioner is in custody in connection with Rahika P.S. Case No. 225 of 2023 registered for the offences punishable under Sections 395, 397, 412, 414, 467, 468, 471, 120(B) of the Indian Penal Code and under Sections 25 (1-B)/a/26/27/35 of Arms Act.
3. As per prosecution case, some miscreants have looted the Canara Bank by making firearm injury to the cleaner of the Bank.
4. Learned counsel for the petitioner submits
Patna High Court CR. MISC. No.37900 of 2024(2) dt.22-05-2024 2/3 that petitioner has falsely been implicated in this case. He further submits that the petitioner has not been arrested on spot and there is no recovery from the conscious possession of the petitioner and the petitioner has surfaced in this case on the basis of the confessional statement of other co-accused person made before the police namely Md. Aftab Ali @ Aftab Ali. He further submits that the petitioner is in custody since 28.10.2023 and other co-accused persons have already been granted bail by this Court vide order dated 13.03.2024 passed in Cr. Misc. No. 18602 of 2024 and vide order dated 12.03.2024 passed in Cr. Misc. No. 15477 of 2024.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the First Informant Report, impugned order dated 01.04.2024 and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner
Patna High Court CR. MISC. No.37900 of 2024(2) dt.22-05-2024 3/3 be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge Vth, Madhubani in connection with Rahika P.S. Case No. 225 of 2023.
