JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Sikta P.S. Case No. 24 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
Allegation as per F.I.R. is of recovery of 06 liters of Kingfisher Strong Beer from the possession of the petitioner and other co-accused person.
Submission of the learned counsel for the petitioner is that earlier cases with respect to drinking of the liquor and not of the recovery and he is on bail in all these cases and he is in custody for more than two months and he is ready to abide by the conditions imposed upon him.

Having heard both sides, in view of the facts and

No.33199 of 2019(2) dt.20-05-2019 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise West Champaran at Bettiah, in connection with Sikta P.S. Case No. 24 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with the condition that in future if any, similar type of case is found against the petitioner, the prosecution shall move for cancellation of his bail bonds.
