JUSTICE PURNENDU SINGH ORAL ORDER 11-09-2025 Heard Ms. Rasika, learned counsel appearing on behalf of the petitioners; Mr. Shyameshwar Dayal, learned APP for the State and Mr. Rajesh Kumar along with Mr. Manaur Alam, learned counsel for the informant.
2. The petitioners seek pre-arrest bail in connection with Phulwari Sharif Case No. 895 of 2024 registered for the offence punishable under Sections 420, 467, 468, 504, 506 and 34 the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioners submitted that there is case and counter case between the parties in respect of certain transaction of money. A complaint was lodged by the petitioners against the informant
Patna High Court CR. MISC. No.34140 of 2025(3) dt.11-09-2025 2/3 and in want of any evidence, the same was closed. Learned counsel informs that the matter can be settled by way of mediation to which, learned counsel appearing on behalf of the informant agrees, as he informs that no purpose would be served, if the petitioners are sent behind the bar.
4. Considering the nature of allegation made in the F.I.R. and desire of the parties, I find that the matter can be resolved outside the Court by way of mediation.
5. The petitioners and informant are directed to appear before the learned District Court on 18.09.2025 at 10:30 AM.
6. Learned District Court is directed to take necessary steps to refer the matter before the learned Mediator of the District Mediation Center.
7. Learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute amicably and thereafter submit his/her report before the concerned learned District Court, well within a period of four months, till then, no coercive action shall be taken against the petitioner in connection with the aforesaid case.
8. In case of failure on the part of the petitioners to appear on 18.09.2025 before the learned District Court or any date fixed by the learned Mediator, the interim protection
Patna High Court CR. MISC. No.34140 of 2025(3) dt.11-09-2025 3/3 granted to the petitioners shall automatically lose its force.
9. In case, the parties fail to reconcile, then in that case, parties may avail appropriate remedy.
10. Accordingly, the present bail application stands disposed of.
