2. The petitioner apprehends his arrest in connection with G.B. Nagar P.S. Case No. 197 of 2016 registered under Sections 20 and 22 of the N.D.P.S. Act.

3. On a secret information, a raid was conducted and three miscreants were apprehended with arms and ammunition and on search, 290 gm of Charas was recovered from their possession. Co-accused persons have disclosed the name of this petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the name of the petitioner has come merely on the confessional

Patna High Court CR. MISC. No.39681 of 2024(3) dt.27-08-2024 2/2 statements of co-accused persons, namely, Golu @ Anshu Singh, Vishal Singh and Vivek Singh. Nothing incriminating article has been recovered from the conscious possession of the petitioner. It is further submitted that for the same occurrence, two F.I.R. have been lodged against the petitioner, except this petitioner has no other criminal antecedent.

5. Learned A.P.P. for the State opposed the prayer for bail.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Court-I-cum-Special Court, Siwan in connection with G.B. Nagar P.S. Case No. 197 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
