Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 307/34 and other sections of Indian Penal Code.

As per prosecution case, this petitioner along with other accused persons assaulted the informant and other family members.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is next submitted that informant is own mother-inlaw of the petitioner and due to property dispute between the parties an occurrence of simple maar-peet took place in which petitioner is alleged to have committed assault. Injury attributed to the petitioner is simple in nature.

No.35375 of 2022(3) dt.14-12-2022 2/2 Considering the backdrop of the case and simple nature of injury, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateVIII, Patna in Patrakar Nagar P. S. Case No. 529 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
