JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2021 Let the defects, if any, be removed within four weeks after complete start of the physical Court. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/341/342/323/324/307/379/504 of the Indian Penal Code. Petitioner Govind Chaudhary has allegedly caused injury on the head. There is no such allegation against Bablu Choudhary @ Bablu Kumar.

Patna High Court CR. MISC. No.45172 of 2021(2) dt.20-12-2021 2/3 Learned counsel for the petitioners submits that the police did not send up the petitioners for trial. The petitioners have got no criminal antecedent. The allegation is false and concocted.

Since petitioner Govind Chaudhary had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner. Hence, his prayer for anticipatory bail is refused.

Considering the nature of material against petitioner Bablu Chaudhary @ Bablu Kumar, let him, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bagaha (Patkhauli) Police Station Case No. 479 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
