In the present case, petitioner is seeking relief for grant of licence in place of her deceased husband who was Fair Price Shop Dealer bearing Licence No.89 of 2007.

The husband of the petitioner was licence holder for running PDS shop who died on 4.8.2016 whereafter petitioner filed an application for grant of licence but till date the same has not been considered.

Learned counsel for the petitioner submits that though earlier there was stay for granting licence on account of pendency of PIL but that order of stay has

Patna High Court CWJC No.367 of 2017 (2) dt.09-08-2017 been vacated and now there is no such impediment for licensing authority to consider and grant licence. In such view of the matter, this Courts directs the concerned authority that if petitioner has already filed an application then the same should be considered in terms of the provision of the Bihar Targeted Public Distribution System (Control) Order, 2016 within a period of three months from the date of receipt/production of a copy of this order. With the aforesaid observation this writ petition is disposed of.
