JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-02-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 25.01.2021, within four weeks of starting of Court proceeding in physical mode.

Heard learned counsel appearing on behalf of petitioners and learned A.P.P. for the State. This application is filed for Modification of order dated 25.06.2020 passed in Criminal Miscellaneous No. 82138 of 2019.

Learned counsel appearing on behalf of the petitioners submits that vide order dated 25.06.2020 passed in Criminal

Patna High Court CR. MISC. No.7752 of 2021(2) dt.24-02-2021 2/2 Miscellaneous No. 82138 of 2019, the petitioners were directed to be released on bail in the event of their arrest or surrender before the court below within the period of six weeks on furnishing the bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of the Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 497 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C., but due to some unavoidable circumstances, petitioners could not surrender before the court below within the stipulated period.

In such view of the matter, the time to surrender of petitioners, as per order dated 25.06.2020 passed in Criminal Miscellaneous No. 82138 of 2019, is further extended by six weeks from today in connection with aforesaid case. Accordingly, the modification application is allowed and the order dated 25.06.2020 passed in Criminal Miscellaneous No. 82138 of 2019 is modified to the above extent.
