2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/379/354B and other allied sections of the Indian Penal Code.
3. It is alleged that all the FIR named accused persons including this petitioner assaulted the informant with lathi. Thereafter, petitioner is alleged to have assaulted on the head of informant's niece. One of the injuries have been found to be grievous.
4. Learned counsel appearing for the petitioner submits that the parties are agnate and due to pre-existing land dispute, casual marpit took place between the parties. Petitioner is 70 years old and claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.35817 of 2023(3) dt.04-08-2023 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Agiaon Bazar Police Station Case No. 200 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
