The petitioners seek bail in Teghra P.S. Case No. 83 of 2015, registered for the offences punishable under Sections 302, 452, 380 and 120B of the Indian Penal Code and 27 of the Arms Act.

The petitioners named in the FIR along with Kanhaiya Yadav, Raja Yadav and Niroj Yadav. The accused persons are alleged to have assaulted Birendra Yadav when the husband of the informant came to his house. Niroj Yadav pushed her and other five accused persons pushed her husband inside the house. Azad Yadav and Kanhaiya Yadav are said to have pushed her husband on the bed. Thereafter Kanhaiya Yadav fired killing her husband

Patna High Court Cr.Misc. No.29982 of 2015 (2) dt.11-08-2015 2/2 on the spot. There is no allegation of assault against the petitioners.

Learned counsel for the informant, however, vehemently opposed the prayer for bail and submitted that the petitioners also demanded money.

Considering the facts aforesaid and the fact that the petitioners are only alleged to have pushed the husband of the informant and Kanhaiya Yadav who alleged to have fired and petitioners are in jail since 23.03.2015, petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S.
