2. The petitioner seeks regular bail in connection with Alamnagar (Ratwara) P.S. Case No. 263 of 2024, lodged on 05.07.2024, under Sections 498A, 328, 307 & 34 of the Indian Penal Code, Section 3⁄4 of the D.P. Act and subsequently Section 304(B) of the IPC has been added on 18.09.2024, pending before the Court of S.D.J.M., Udakishunganj, Madhepura.
3. As per the prosecution, FIR has been lodged against six named accused persons, including the present petitioner. It is alleged that the accused persons mixed an intoxicating substance in the water given to the informant, which caused her health to deteriorate continuously. Consequently, she was sent back to her maternal home, where her family admitted her to a hospital. Unfortunately, she died during the course of treatment.
4. Learned counsel for the petitioner submits that the

It is further submitted that the petitioner has been unnecessarily implicated in the present case. Counsel further submits that the petitioner's wife is a short-tempered person and the allegations made in the FIR are absolutely false. It is also submitted that the petitioner has been in custody since 15.10.2024 and has clean criminal antecedents.

Learned APP for the State opposes the prayer for bail and submits that there is a specific allegation in the FIR stating that, on the night of the incident, the family members of the petitioner gave something in the water, which led to the death of the informant. Counsel further submits that the petitioner is none other than the husband of the informant, therefore, this statement cannot be ignored.
6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
