2. The petitioner seeks bail in a case registered for the offence punishable under Section 96 of the B.N.S.

3. As per the prosecution case, the informant alleged that the petitioner kidnapped her minor daughter.

4. Learned counsel for the petitioner submits at the outset that the present case arises out of love affair between the petitioner and the daughter of the informant, however, the informant had lodged the present case with allegation on the petitioner of having enticed away her daughter. The victim was subsequently recovered and she has admitted in her statement under Section 183 of the B.N.S.S. that she has voluntarily gone with the petitioner and has also solemnized marriage with him and has also been blessed with a child. The bail rejection order indicates that the informant has also accepted the marriage of

No.36036 of 2026(2) dt.08-06-2026 2/2 the petitioner and her daughter and as a matter of fact, the present bail petition of the petitioner has been affidavited by the said informant, who is now the mother-in-law of the petitioner. Further, the petitioner has no criminal antecedent and he is a young boy aged about 19 years, who is languishing in custody since 15.05.2025.

5. Learned APP for the State opposed the grant of bail on the basis of allegations made in the First Information Report.

Taking into consideration the facts and circumstances and considering consensual nature of relationship between the petitioner and the informant, coupled with the fact that they are now married with a child, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari/concerned Court below in connection with Pipra P.S. Case No. 56 of 2025. (Soni Shrivastava, J) anand/- U T
