JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application, through Video Conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 04.12.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner seeks bail in connection with Garaul P.S. Case No.312 of 2019 registered under Sections 147, 149, 333, 337, 338, 341, 323, 353, 307, 427, 504 and 506/120B of the Indian Penal Code.

No.33034 of 2020(2) dt.15-12-2020 2/3 The accusation is that on 31.08.2019 at about 11.50 A.M., the informant Vinod Kumar being the Officer Incharge of Police Station-Goraul (Kathara O.P.) along with other police personnel was discharging the official duty at Kathara O.P. At that time, 28 persons, named in the F.I.R., including the petitioner along with 70-80 unknown gents and ladies having lathi and danda in their hands attacked at the Police Station. While the police personnel and Circle Officer, Chehrakalan tried to convince them but they started pelting bricks and stones at the O.P., in which the Government vehicle, one Maruti Car and glass of the window became damaged. In the occurrence, the police personnel also sustained injury.
Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act is attributed to him. The petitioner has no criminal antecedent and is in custody since 29.05.2020. On investigation, the police has already submitted the charge-sheet against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the
