The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Excise Act, 2016.

I have gone through records of the present case. There is no recovery from the conscious possession of the petitioner. Petitioner bears no criminal antecedent. In para-7 of the bail petition it is mentioned that petitioner is the owner of New Wagnor motor car bearing Chesis No. MA3EWDE1SSOOE 78335, Engine No. K10BN5051168 and the said car was parked by the car driver beside the road but the police arbitrarily seized the said car with ulterior motive. On the basis of document of seized Wagnor car, the petitioner has been implicated in the present case.

No.33087 of 2019(3) dt.22-08-2019 2/2 In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IInd-cum-Special Judge Vaishali at Hajipur in connection with Hajipur Sadar Police Station Case No. 169 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
