2. The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 379, 504, 506/34 of the Indian Penal Code.
3. It is alleged that this petitioner took Rs. 4,00,000/- (four lacs) from the informant and said that he would deposit the amount in one Sahu Shree Mutual Benefit Company, where wife of petitioner is an agent, and gave assurance that he would return the money with interest. It is further alleged that when after two years informant demanded his money, petitioner refused to pay the same.
4. It is submitted on behalf of petitioner that petitioner is neither agent nor employee in the aforesaid company. In fact, wife of the petitioner is agent of the company and informant willfully and voluntarily deposited some amount in the said company. Petitioner never took any money from the informant

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Ara in connection with Ara Nawada P.S. Case No. 28 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
