2. Petitioner seeks bail who is in custody since 13.02.2026 in connection with Belaganj P.S. Case No. 168 of 2021, F.I.R. dated 08.06.2021 for the offences punishable under Sections 147,149,341,323,504,302 of IPC.
3. Allegation against the petitioner is that he alongwith other co-accused persons assaulted the informant and his family members by means of lathi, danda, bricks and stone. During the occurrence, informant's father sustained head injury and during his treatment he died.
4. Learned counsel for the petitioner submits that it
2/4 appears from the FIR itself that due to land dispute the present occurrence has taken place. Although the petitioner is named in the FIR but there is no specific allegation of any assault or overt-act attributed against the petitioner rather there is general and omnibus allegation against all the accused persons including the petitioner and co-accused persons, namely, co-accused Pankaj Kumar@ Pankaj Yadav, Kishori Yadav, Binod Yadav, Sudhir Yadav, Kapil Yadav, Amarjeet Kumar, Siya Sharan Yadav have been granted bail by different Coordinate Benches of this Hon'ble Court vide orders dated 16.4.2025,3.5.2023, 29.3.2023 and 16.3.2023 passed in Cr. Misc. Nos. 19154/2025, 7221/2023, 669/2023, 10326/2023 respectively and the police after investigation submitted the charge sheet against the petitioner and the petitioner is in custody since 13.02.2026.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner is named in the FIR, apart from that, the petitioner carries one more case other than the present one but fairly submits that the petitioner is on bail in the said case, as mentioned in para-3 of the bail petition.
6. Considering the aforesaid facts and circumstances
3/4 and co-accused persons have been granted bail by different Coordinate Benches of this Hon'ble Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-II, Gaya in connection with Belaganj P.S. Case No. 168 of 2021, subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned
4/4 order shall not be delayed for purpose of or in the name of verification.
