Petitioner seeks bail in Barachatti P.S. Case no. 148 of 2019 registered under sections 20/22 of the N.D.P.S. Act. Mr. Bikramdeo Singh, learned counsel for the petitioner submits that 682 gms. of opium was recovered from joint house of the petitioner but his prayer for bail was rejected on the ground that commercial quantity was recovered. In fact, 682 gms. of opium is more small quantity but less than commercial quantity.

Petitioner in in jail since 27.03.2019. Petitioner has already remained in jail for about two years. Taking into consideration the facts, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (rupees ten thousand) with two sureties of the like
