Initially, the case was registered against unknown but in course of investigation, one Ramesh Goswami, who happens to be driver of the deceased, claimed that at the time of alleged occurrence, he was driving the vehicle, in which, deceased was sitting and it was the petitioner and others, who came there and dragged the deceased from vehicle and petitioner shot fire of carbine on the deceased, as a result of which, deceased died then and there.

No doubt, at subsequent stage of the investigation, the aforesaid witness, Ramesh Goswami was also made accused on the accusation of conspiracy but taking the aforesaid facts and

Patna High Court Cr.Misc. No.33341 of 2015 (6) dt.05-11-2015 2/2 circumstances as well as taking note of criminal antecedent of the petitioner, I am not inclined to release the petitioner on bail and, accordingly, prayer for bail of the petitioner in connection with Narpatganj P.S. Case No. 50 of 2007 corresponding to Sessions Trial No. 189 of 2014 pending in the court of learned Additional Sessions Judge-II, Araria stands rejected.
