JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 07-09-2017 The present application has been filed for restoration of the name of Company in the register of the Registrar of the Companies as the name of the Company has been struck off on the ground that the Company has not taken steps under the Companies Act with respect to filing the return and the Registrar has arrived to a conclusion that the Company is not carrying the business or is not under operation and struck off the name of the Company and notified the same in the gazette.

Learned counsel for the Company submits that the Company is running, due to some mistake, proper return could not be filed though proper audit was done in terms of the Companies Act.

Patna High Court COM PET No.4 of 2016 dt.07-09-2017 Let the Registrar of the Companies should restore the same position of the petitioner Company with a direction to the petitioner company to file proper return within a period of thirty days from the date of its restoration, in failure to file return, the Registrar of the Companies will be at liberty to take action in accordance with law. The petitioner Company will deposit all the fees as per Companies Act.

With the aforementioned observation and direction, this company petition is disposed of.
