JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel, appearing for the informant.

Petitioner, being father-in-law is languishing in jail custody since 19-02-2015 in a case registered under Sections304B, 201/34 of the Indian Penal Code. Although the informant has claimed in his fardbyan that when he reached near the place of occurrence, the deceased disclosed that she was burnt by her in-laws but submission on behalf of the petitioner is that according to statement of the informant, the police had already reached on the place of occurrence before arrival of the informant but police did not record the statement of deceased and, therefore, the claim of

Learned counsel for the petitioner also drew my attention towards paragraph-12 of the case diary and submitted that door of the room of the deceased was found broken from inside and the wet quilt and bed was found in the aforesaid room and the aforesaid circumstances suggest that an attempt to save the life of the deceased, was taken. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rani Talab P.S. Case No. 92 of 2014 to the satisfaction of Sri Kumar Madhvendra, J.M.-Ist Class, Danapur, Patna.
