JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named but they were arrested in connection with another case and allegedly, on the basis of disclosure made by them the looted mobile in broken condition was recovered from a field.

The contention on behalf of the petitioners is that so called recovery is only high handedness of the police and as a matter of fact, the aforesaid recovery is said to have been made on 23.12.2014 but surprisingly enough petitioners were remanded in the present case on 24.02.2015.

Patna High Court Cr.Misc. No.33842 of 2015 (6) dt.10-12-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 282 of 2014.
