JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2015 The petitioner is languishing in custody since 14.03.2015 in connection with Sonpur P.S. Case No. 82 of 2015 for the offences instituted under Sections 457, 380, 414 and 411/34 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

It is alleged that on search by the police, two Jiutiya like gold was recovered from possession of the petitioner. It is further alleged that one big battery worth Rs. 10,000/- was also recovered. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and he is in custody since 14.03.2015 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner is implicated in the

Patna High Court Cr.Misc. No.29304 of 2015 (2) dt.05-08-2015 2/2 present case due to mistake of fact. Other co-accused has been granted bail by the learned court below itself. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Saran at Chapra, in connection with Sonpur P.S. Case No. 82 of 2015(G.R. No. 1141/2015).
