JUSTICE SUDHIR SINGH) 01-09-2025 The present contempt application has been filed for initiation of contempt proceedings against the opposite parties for willful disobedience of order dated 04.02.2019 in CWJC No.1973 of 2019 passed by a Co-ordinate Bench of this Court, operative portion of which reads as under:

"Having heard Mr. Devendra Kumar, learned counsel appearing for the petitioner and Mr. Mrityunjay Kumar, learned Assisting Counsel to Additional Advocate General No.6 we are persuaded to dispose of the writ petition affording liberty to the petitioner to approach the District Magistrate, Sitamarhi raising his grievance who either by himself or by authorizing any person competent to do so would consider and dispose of the same and since it relates to public fund, a disposal within three months of its filing would be appreciated."

2. A show-cause dated 22.02.2023 has been filed on behalf of O.P. Nos.6 to 8. The following statements have been made in paragraph nos.5 to 10:

"5. That it is respectfully submitted that in the light of the abovementioned order passed by the Hon'ble High Court in CWJC No.1973/2019 the petitioner filed application for compliance of the order passed by the Hon'ble High Court.

6. That it is respectfully submitted that in compliance with the abovementioned order passed by the Hon'ble High Court, a case record bearing Miscellaneous Case no.47/2022 Shatrughan Singh Vs the State of Bihar and others was initiated in the learned court of the Collector, Sitamarhi and report was called for from the District Panchayati Raj Officer, Sitamarhi vide letter no.1949 dated 24.09.2022 as well as the petitioner was issued notice to produce this argument but the petitioner did not appear.

7. That it is respectfully submitted that a report was submitted by the District Panchayat Raj Officer, Sitamarhi vide letter no.260 dated 28.01.2023.

8. That it is respectfully submitted that after receipt of the abovementioned report from the District Panchayat Raj Officer, Sitamarhi, the learned GP, Sitamarhi was heard in the learned court of the Collector, Sitamarhi on the report submitted by the District Panchayat Raj Officer, Sitamarhi who is course of hearing opined that there is irregularities committed by the concerned persons and hence action be taken against the guilty persons.

9. That it is respectfully submitted that after hearing

Patna High Court MJC No.1537 of 2021(4) dt.01-09-2025 3/3 the learned GP, Sitamarhi as well as going through the papers and report submitted by the District Panchayat Raj Officer, Sitamarhi, it was observed by the learned Collector, Sitamarhi that as per report of the District Panchayat Raj Officer, Sitamarhi, there is allegation of gross irregularities and defalcation of Government funds in implementation of Gramin Peya Jal Nischay Yojna in Gram Panchayat Raj, Manpur in question.

10. That it is respectfully submitted that upon such observation as mentioned above an order contained in Memo no.264/Dist. Legal dated 02.02.2023 has been passed by the learned Collector, Sitamarhi in Miscellaneous Case No.47/2022 Shatrughan Singh Vs. The State of Bihar & ors."

3. The show cause filed on behalf of O.P. is accepted by this Court. Thus, the order of the Co-ordinate Bench has already been complied with.

4. Considering the statements made in the paragraphs referred above, we are of the considered opinion that no further order is required to be passed in this contempt application.

5. Accordingly, the present application stands disposed of.
