JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is said to have been caught on the spot along with co-accused, Lale Mian but according to prosecution case itself, the alleged recovery of smack was made from conscious possession of co-accused, Lale Mian who disclosed before the informant that he had come to deliver the aforesaid seized smack to the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 26.03.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.31049 of 2015 (2) dt.13-08-2015 2/2 with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 251 of 2015.
